Buying a property in Queensland

Before you commit, we can help you understand the contract, the seller’s disclosure documents and the issues that need closer investigation. We can discuss finance and inspection conditions, relevant searches and the dates you need to keep in mind.

Contract reviews and special conditions

A standard form does not necessarily mean a standard transaction. We review contracts in the context of your circumstances, explain the obligations and identify terms that may need clarification or further negotiation.

Talk to us before signing where possible, particularly if you are concerned about a deadline, a proposed condition or something you have been told verbally. Written advice helps you make the decision with a clearer understanding of the documents.

Form 2 seller disclosure

Queensland’s seller disclosure scheme generally requires a seller to give the buyer a completed Form 2 disclosure statement and the prescribed certificates before the buyer signs the contract, unless an exception applies. We can help you understand the requirements for your transaction and review the disclosure material.

Disclosure is not a substitute for all of a buyer’s own enquiries. The information you need will depend on the property and your intended use. See the Queensland Government’s seller disclosure guidance for an overview.

Due diligence and property searches

The right enquiries depend on what you are buying and what you intend to do with it. We help you consider title information, registered interests, property searches and other matters relevant to the transaction.

Off-the-plan purchases

Buying a property before it is completed calls for a careful look at the contract and supporting disclosure material. We can explain the proposed lot, relevant conditions, timing provisions and the way the documents address changes before settlement.

Our focus is helping you understand the commitment you are making and the issues to consider before signing, rather than assuming an off-the-plan purchase works in the same way as an existing property sale.

Non-standard transfers and commercial transactions
